12. Copyright Policy
12.1 Statement of Intellectual Property Integrity
Codehub operates as an intellectual property marketplace and developer ecosystem. We strictly respect the intellectual property rights of software engineers, software architects, corporate entities, and independent creators. We maintain a zero-tolerance mandate regarding copyright infringement, software piracy, unauthorized redistribution, and intellectual property theft.
This Copyright Policy governs the mechanisms through which Codehub addresses claims of copyright infringement, outlines the procedure for filing a formal Digital Millennium Copyright Act (DMCA) Takedown Notice, and details the counter-notice legal framework for Authors.
12.2 Proactive Measures & Author Verification
While Codehub provides the hosting infrastructure, indexing architecture, and payment gateways for digital assets, the ultimate legal responsibility for code originality rests on the uploading Author.
Authors represent and warrant that they possess all absolute copyrights, commercial distribution licenses, and permissions for any third-party code libraries, open-source frameworks, or components included within their products.
Codehub reserves the right to run automated static code analysis, software plagiarism checks, and repository matches against public archives to proactively mitigate infringement risks.
12.3 DMCA Takedown Notification Requirements
If you are a copyright owner, or a legally authorized agent acting on behalf of a copyright owner, and you believe that any software code, script, application template, text, or graphic asset hosted on Codehub directly infringes upon your exclusive copyrights, you may submit a formal, legally binding DMCA Takedown Notice to our Designated Copyright Agent.
To be legally valid, your DMCA Takedown Notice must be submitted in writing (via email or physical mail) and must contain the following structural information:
Identification of the Protected Work: A comprehensive description of the copyrighted work or software codebase that you claim has been infringed upon, including specific repository links or registration numbers where applicable.
Identification of the Infringing Material: The exact URL, product page link, or specific asset path on Codehub containing the allegedly infringing material, with enough granularity to allow our system administrators to locate and isolate the asset.
Contact Information: Your full legal name, corporate title, mailing address, telephone number, and active professional email address.
Statement of Good Faith: An explicit statement stating that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its legal agent, or statutory law.
Statement of Accuracy under Penalty of Perjury: A statement, made under penalty of perjury, that the details provided in your notification are entirely accurate, and that you are the legitimate copyright owner or are legally authorized to act on their behalf.
Physical or Electronic Signature: A valid physical or electronic signature of the copyright owner or their authorized legal representative.
Failure to include all six mandatory elements will result in the immediate invalidation of your request. All DMCA notices must be routed to: copyright@codehub.com.
12.4 Processing, Asset Isolation, and Author Notification
Upon receipt of a legally compliant DMCA Takedown Notice, Codehub will execute the following operational sequence:
Immediate Takedown/Disablement: We will immediately remove, disable access to, or quarantine the disputed software asset from public search results and checkouts.
Author Notification: We will transmit a complete copy of the DMCA notice, including your contact information and statements, to the Author who originally uploaded the code.
Financial Escrow Freeze: Any accrued or pending financial earnings generated by the disputed digital asset will be placed into a secure legal escrow account until the dispute is resolved.
12.5 Counter-Notification Framework for Codehub Authors
If you are an Author on Codehub and your item was removed or disabled due to a DMCA notice, and you strongly believe that this action was the result of a mistake, misidentification, or a fraudulent claim, you possess the legal right to file a formal Counter-Notification.
Your Counter-Notification must be a written communication sent to our Designated Copyright Agent containing:
Identification of the specific material that was removed or disabled, and the exact URL location where it appeared before removal.
A formal statement made under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
Your full legal name, physical address, email address, and telephone number.
A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if you reside outside of the United States, for any judicial district in which Codehub may be located, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
Your electronic or physical signature.
Next Steps in the Legal Dispute:
Upon receiving a valid Counter-Notification, Codehub will promptly forward a copy to the original claimant. The claimant then has ten (10) to fourteen (14) business days to notify Codehub that they have filed a formal legal action seeking a court order to restrain the Author from engaging in the infringing activity relating to the material on Codehub. If no such judicial filing notice is provided to us within 14 business days, Codehub is legally authorized to restore the disabled asset to the public marketplace.
12.6 Repeat Infringer Disciplinary Policy
Codehub takes intellectual property security seriously. In accordance with international copyright laws, we enforce a strict Repeat Infringer Policy.
Any Author account that accumulates two (2) or more validated DMCA copyright strikes will face immediate, permanent account termination. Upon termination under this policy, all active product listings will be permanently expunged, and all pending or future financial balances will be permanently forfeited to cover platform legal and administrative overhead costs.
